Birth Injury
Birth injury occurs when an infant is injured due to delivery complications. A birth injury can range from something as mild as a small bruise, to something as serious as brain damage or other permanent injury.
Birth injury may result from improper use of forceps, a large infant trying to pass through an unusually small birth canal/pelvic region, improper application of traction in an attempt to dislodge a baby experiencing shoulder dystocia, or oxygen deprivation. Birth injury may also occur as a result of the baby’s positioning in the womb.
Birth injury is a common occurrence, though usually the injury is not serious. In deliveries that are complicated by one of the situations mentioned above, however, birth injury can result in substantial trauma to the infant or mother. A mother’s doctor and medical team should monitor the mother throughout labor and delivery in order to be aware should any complications arise. The physician should be aware of, among other things, possible complications resulting from a large baby, the mother’s medical history, irregularities in the fetal heartbeat, and umbilical cord positioning. If the doctor fails to monitor these and other things, or fails to respond properly to situations that arise during the delivery, he may be considered negligent with regard to the duty he owes his patients.
